SC dismisses plea seeking direction to CBSE and Delhi Govt. to waive students exam fees

 

 

New Delhi, November 17, 2020: The Supreme Court bench of Justices Ashok Bhushan, R. Subhash Reddy and M. R. Shah today dismissed a plea seeking direction to the CBSE and the Delhi government to waive examination fees for students of classes 10 and 12 in the current academic year.

 

This was in view of the ongoing pandemic and consequent financial problems being faced by parents, the plea said. The plea was filed by the NGO Social Jurist against the September 28 order of the Delhi High Court asking the AAP government and the Central Board of Secondary Education (CBSE) to treat the PIL as a representation and take a decision “in accordance with law, rules, regulations and government policy applicable to the facts of the case” within three weeks.

 

Justice Bhushan said that the bench cannot pass an order exempting the fees. Its a Government decision. How can the Court direct this?

 

The petitioner insisted that the bench can exempt at least 50 percent of the fees. We have filed the representation before the Delhi Government. They rejected, it and CBSE not responded to it. Only 10% students studying in Government schools.

 

Justice Bhushan said, “we are not inclined to hear this petition.” and dismissed it.
